Terms of Service for Boozted Hosting LLC
Definitions
In these Terms of Service, the terms “The Company”, “We”, “Us”, and “Our” refer to Boozted Hosting LLC, the provider of the game server hosting services. The term “Service” refers to the services provided by The Company. The term “User”, “You” and “Your” refers to the individual or entity that has agreed to these Terms of Service and is using the Service.
Non-Discrimination Policy
The Company is committed to providing a discrimination-free environment. We strictly prohibit discrimination or harassment of any kind, including but not limited to discrimination or harassment based upon race, color, religion, gender, age, national origin, disability, or any other protected class. This policy applies to all users of the Service and extends to all aspects of our services. Any user found to be in violation of this policy may have their access to the Service suspended or terminated.
Right to Refuse
Boozted Hosting LLC reserves the right to refuse service to anyone for any reason not prohibited by law. This includes, but is not limited to, situations where the provision of service would lead to a violation of company policies, risk to employee safety, or cause disruption to our operations. This policy is subject to all applicable laws and regulations and does not discriminate on the basis of race, color, religion, national origin, sex, age, disability, or any other characteristic protected under the law.
1. Acceptance of Terms
By accessing and using the services provided by Boozted Hosting, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you are prohibited from using or accessing our services.
1.1 Support Policy
By using Boozted Hosting LLC’s services, you agree to comply with and be bound by our Support Policy, which outlines the terms, scope, and limitations of the technical support provided. The Support Policy is available on our discord and may be updated from time to time. Continued use of our services constitutes acceptance of any changes to the Support Policy.
2. Description of Service
Boozted Hosting provides game server hosting services. You pay a fee each month to set up the server in the cloud at one of our secure data centers so that the server is online 24×7.
3. User Conduct
Users are responsible for all activities that occur under their account. Any illegal activities, including but not limited to, hacking, distributing copyrighted material, or engaging in DDoS attacks, will result in immediate termination of service. Misuse of our servers can result in termination of service. A list of the banned uses of our servers is located on our website.
4. Warranties
Users are responsible for keeping track of their data, we are not liable for any loss of data due to the fault of the customer or any other person with allowed access to the Service in question. We are unable to fix corrupted and/or broken files.
5. Payment and Fees
We use both Stripe and Paypal as payment gateways for our services. When purchasing a product you are redirected to a different page that is hosted by the gateway in use. If choosing an auto-pay subscription, we reserve the right to charge your account on a per term basis. Details of the pricing of our services and other financial policies will be provided on our site.
5.1 Payment Methods
- For normal clients: We accept credit card payments.
- For big projects: We accept ACH and credit card payments. We do not accept checks.
6. Indemnification
You agree to indemnify, defend, and hold harmless Boozted Hosting LLC, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Service from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service using your account.
7. Modifications to Terms of Service
The Company reserves the right to modify these terms at any time. We will make reasonable efforts to inform users of any changes.
8. Limitation of Liability
Boozted Hosting LLC will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use of our services.
9. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed under the laws of the state of North Carolina without regard to its conflict of law provisions. You agree that any legal action or proceeding related to this website will be brought exclusively in a federal or state court of competent jurisdiction in North Carolina.
