Terms of Service for Boozted Hosting LLC<\/h1>\n

Definitions<\/b> In these Terms of Service, the terms \u201cThe Company\u201d, \u201cWe\u201d, \u201cUs\u201d, and \u201cOur\u201d refer to Boozted Hosting LLC, the provider of the game server hosting services. The term \u201cService\u201d refers to the services provided by The Company. The term \u201cUser\u201d, \u201cYou\u201d and \u201cYour\u201d refers to the individual or entity that has agreed to these Terms of Service and is using the Service.<\/p>\n

Non-Discrimination Policy<\/b> The Company is committed to providing a discrimination-free environment. We strictly prohibit discrimination or harassment of any kind, including but not limited to discrimination or harassment based upon race, color, religion, gender, age, national origin, disability, or any other protected class. This policy applies to all users of the Service and extends to all aspects of our services. Any user found to be in violation of this policy may have their access to the Service suspended or terminated.<\/p>\n

Right to Refuse<\/b> Boozted Hosting LLC reserves the right to refuse service to anyone for any reason not prohibited by law. This includes, but is not limited to, situations where the provision of service would lead to a violation of company policies, risk to employee safety, or cause disruption to our operations. This policy is subject to all applicable laws and regulations and does not discriminate on the basis of race, color, religion, national origin, sex, age, disability, or any other characteristic protected under the law.<\/p>\n

1. Acceptance of Terms<\/b> By accessing and using the services provided by Boozted Hosting, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you are prohibited from using or accessing our services.<\/span><\/p>\n

1.1 Support Policy<\/span><\/b> By using Boozted Hosting LLC\u2019s services, you agree to comply with and be b<\/span>ound by our Support Policy, which outlines the terms, scope, and limitations of the technical su<\/span>pport provided. The Support Policy is available on our discord and may be updated from time to time. Continued use of<\/span> our services constitutes acceptance of any changes to the Support Policy.<\/p>\n

1.2 Age Restriction<\/b> You must be at least 13 years of age to use the Service. If you are under 18 years of age, you may only use the Service with the permission of a parent or legal guardian. By using our Service, you confirm that you meet this age requirement.<\/p>\n

1.3 Account Security<\/b> You are responsible for maintaining the confidentiality of your account login information (email, username, and password). You are fully responsible for all activities that occur under your account. You agree to immediately notify Boozted Hosting LLC of any unauthorized use or suspected breach of security. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.<\/p>\n

1.4 Severability<\/b> If any provision of these Terms of Service is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms of Service unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.<\/p>\n

2. Description of Service<\/b> Boozted Hosting provides game server hosting services. You pay a fee each month to set up the server in the cloud at one of our secure data centers. While we aim for the server to be online 24\u00d77, service availability is subject to scheduled maintenance and Force Majeure events as described in Section 9.<\/p>\n

3. User Conduct<\/b> Users are responsible for all activities that occur under their account.<\/p>\n

We have a zero-tolerance policy for Child Sexual Abuse Material (CSAM). Any storage, distribution, or access of CSAM will result in immediate termination, a permanent ban, and a report to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement agencies.<\/b><\/p>\n

Users must also strictly comply with the End User License Agreements (EULA) of any software or games hosted on our services (e.g., the Minecraft EULA). Violations that result in IP blacklisting or legal action against the Company are grounds for termination.<\/p>\n

Any illegal activities, including but not limited to, hacking, distributing copyrighted material, or engaging in DDoS attacks, will result in immediate termination of service. Misuse of our servers can result in termination of service. A list of the banned uses of our servers is located on our website.<\/p>\n

4. Warranties<\/b> Users are responsible for keeping track of their data, we are not liable for any loss of data due to the fault of the customer or any other person with allowed access to the Service in question. We are unable to fix corrupted and\/or broken files.<\/p>\n

5. Payment and Fees<\/b> We use both Stripe and Paypal as payment gateways for our services. When purchasing a product you are redirected to a different page that is hosted by the gateway in use. If choosing an auto-pay subscription, we reserve the right to charge your account on a per term basis. Details of the pricing of our services and other financial policies will be provided on our site.<\/p>\n

5.1 Accepted Payment Methods<\/b> The Company accepts payment via major credit and debit cards (Visa, MasterCard, American Express, Discover) for all service tiers.<\/p>\n

For Enterprise or Custom Solutions, we may, at our sole discretion, accept payment via ACH or Wire Transfer in addition to major credit cards. Please contact our billing department to request approval for these methods.<\/p>\n

We strictly do not accept personal checks, cashier\u2019s checks, money orders, or cash. Any attempt to pay via these methods will be rejected.<\/p>\n

5.2 Refund Policy<\/b> All sales are final. No refunds will be issued except in cases of proven credit\/debit card theft. The cardholder or client must provide verifiable proof of theft to authorize a refund.<\/span><\/p>\n

6. Indemnification<\/span><\/b> You agree to indemnify, defend, and hold harmless Boozted Hosting LL<\/span>C, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Service from and against all losses, expenses, damages, and costs, including reasonable attorneys\u2019 fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service using your account.<\/p>\n

7. Modifications to Terms of Service<\/b> The Company reserves the right to modify these terms at any time. We will make reasonable efforts to inform users of any changes.<\/p>\n

8. Limitation of Liability<\/b> Boozted Hosting LLC will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use of our services.<\/p>\n

9. Force Majeure (Acts of God)<\/b> Boozted Hosting LLC shall not be liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, acts of God, natural disasters (including but not limited to fire, flood, earthquake, storm, hurricane, or other natural elements), acts of war, terrorism, riots, civil disorders, rebellions, or revolutions, or power and\/or network failures outside of our immediate infrastructure. The Company is not responsible for any data loss, file corruption, or service downtime resulting from such events.<\/p>\n

10. Data Retention<\/b> In the event of non-payment, server data will be retained for a maximum of 10 days. After 10 days of an invoice being overdue, all associated data will be permanently deleted and cannot be recovered.<\/span><\/p>\n

11. DMCA Compliance<\/span><\/b> We respect the intellectual pro<\/span>perty rights of others. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to clear notices o<\/span>f a<\/span>lleged copyright infringement. If you believe that your intellectual property has been posted on one<\/span> of our servers in violation of your rights, you must email <\/span>dmca@boozted.net<\/span><\/b> with valid proof of ownership and details of the infringement. We reserve the right to terminate the accoun<\/span>ts of repeat infringers.<\/span><\/p>\n

You agree that any legal action or proceeding related to this website will be brought exclusively in a federal or state court of competent jurisdiction in North Carolina.<\/p>\n
